ماده 1 قانون ثبت علایم تجاری و اختراعات در تعریف علامت تجاری مقرر می دارد:
" علامت تجاری عبارت از هر قسم علامتی است اعم از نقش – تصویر – رقم – حرف – عبارت – مهر – لفاف و غیر آن که برای امتیاز و تشخیص محصول صنعتی ، تجاری یا فلاحتی اختیار می شود. ممکن است یک علامت تجاری برای تشخیص امتیاز محصول جماعتی از زراعین یا ارباب صنعت و یا محصول یک شهر و یا یک ناحیه از مملکت اختیار شود".
از ماده فوق مستفاد می شود که نوع علامت تجاری ( لوگو، برند، آرم ، مارک ) جنبه حصری ندارد ، بلکه با توجه به ابتکار افراد برای شناسایی محصولات واحدهای تولیدی ، صنعتی یا خدماتی مانند حمل و نقل زمینی ، هوایی یا دریایی می تواند به صورت کلمات ، حروف، ارقام، ترسیمات ، عکس ، شکل ، رنگ ، تصویر ، برچسب یا ترکیب آنها باشد.
امروزه، بسیاری از کشورها اجازه می دهند شکل هایی از علائم تجاری که قبلاَ مرسوم نبوده اند نیز ثبت شوند مانند علائم سه بعدی، علائم صوتی ، رنگ ها و یا بوها.اما در مقابل برخی از کشورها برای آنچه که بعنوان علامت تجاری قابل ثبت هستند محدودیت هایی قائل شده اند و عموماَ اجازه ثبت علائمی را می دهند که قابل مشاهده باشد.
در هر صورت ،علامت تجاری نه تنها باید با سایر علایم تجاری تمایز و تفاوت داشته باشد و با نوع و جنس کالا نیز ارتباط تنگاتنگ نشان دهد، بلکه باید توام با ابتکار و نوآوری ترسیم و تنظیم گردد و از اسامی عام و گمراه کننده در علامت استفاده نشود، مثلاَ کلمه " شکر " را که عام و ویژه کالا و جنس خاص است ، نمی توان به عنوان علامت انتخاب نمود.
به عبارتی دیگر، علامت تجاری باید جدید و ابتکاری بوده و گمراه کننده نباشد.
